本 Policy 適用於年滿 18 歲且另行取得 Educator capability 的台灣使用者，在 Swellz Studio 主動使用 AI、speech 或 content-processing 功能時的資料處理 boundary。Account signup、Privacy Policy acknowledgement 或 OS microphone permission 本身，不等同完成此 feature 的 purpose-specific action。
1. Feature boundary
適用範圍包括 Educator 在 Studio 內明確啟動，或 publication workflow 清楚表示必要性的 editing、caption/transcription、translation、creator-directed text/media transformation/generation，以及另行核准的 realtime speech-to-text 等功能。
Learner 一般 signup 或 Clip viewing 不以本 AI/speech action 為前提。Direct Learner generative-AI conversation 不是 Current P0 必要功能。
2. Input, output and provider facts
依功能不同，可能將 Educator 提供的 text/script/caption/image/video/audio、workspace/content identifier 或必要 request metadata 傳送至 approved provider。輸出可能包括 transcript、caption、translation、edit suggestion、generated content、moderation 或 quality observation。
Production 前必須固定實際 provider entity、service/model/endpoint、purpose、data category、processing country/region、subprocessor、recipient、retention/deletion、incident term、cross-border treatment 及 market eligibility，並使本 Policy、feature notice、provider register 與 shipping implementation 一致。
在上述 facts 未完成核准前，本草案不授權任何特定 provider route，也不得以日本 provider conclusion 替代台灣審查。
3. Model training and improvement prohibited
Current P0 不使用 Educator 或其他使用者之 content/personal data 進行 model training、fine-tuning 或 model improvement，也不允許 third-party provider 為該目的使用。若 provider contract、account setting 或 endpoint control 無法符合此要求，該 route 不得 Production activate。
4. Raw voice and uploaded source media
如啟用 realtime voice function，僅在提供功能必要範圍進行 transient processing，raw microphone audio 不作為 Swellz persistent source artifact 保存。若 provider 為 security、abuse monitoring 或其他合法目的存在 retention，必須確認並揭露實際 retention/deletion；「Swellz 不保存」與「provider zero retention」不是同一件事。
Educator 有意上傳為 Studio source media 的 audio/video 則屬不同 data category，可依 creation/editing/publication/rights/safety/support/audit purpose 保存。
5. Cross-border processing and Taiwan PDPA
若 AI/provider 在台灣境外處理個人資料，應依台灣 PDPA 與適用規範，將實際 purpose、data category、period、territory、recipient、method、rights route 及必要 transfer information 納入對使用者的告知與 provider governance。
目前審查尚未建立一項要求此功能所有資料必須一律留在台灣境內資料庫的通用規則；但任何特定 provider、資料類型、主管機關要求或未來法規仍可形成更嚴格 gate。
6. Clone unsupported and rights
Current P0 不提供 voice clone、face clone 或 persona replication。一般 content-processing permission 不得被解讀為使用者授權建立這些功能。
AI generation 不保證 output 必然享有著作權，也不清除第三方 copyright、trademark、music、performance、likeness、voice、privacy/publicity 或 provider/model license 問題。Educator 只保留其實際依法擁有或控制之權利。
7. Human review and significant decisions
AI/model output 不作為 rights、重大 moderation、account termination、monetization removal、payout forfeiture 或其他重大 legal/business action 的唯一 final authority。重大處理依適用 policy、evidence、human review 與 appeal/restoration route 辦理。
8. Taiwan AI governance monitoring
台灣人工智慧基本法及主管機關後續公布之風險分類、透明、責任、安全、privacy/data governance 或產業規範應持續追蹤。本草案不自行將 Swellz 或本功能分類為特定法定 high-risk category。
若後續規則對本 feature 造成重大義務，需先更新 ServiceScope、JurisdictionModule、Provider/Generation Route authority、LegalDocument 及必要 user action，再行啟用。
9. Action, refusal and withdrawal
需要 purpose-specific acceptance/consent/action 的 feature，應在 feature entry 顯示適用 document version、scope 及必要 provider information，並由 Backend 保存 action evidence。
拒絕或撤回可能停止未來該 purpose 的 processing，但不代表所有過去 lawful processing、security/rights evidence 或 legal/audit record 都必須立即刪除。實際刪除與 retention 依 Privacy Policy、適用法律及 approved retention schedule。
10. Production boundary
本文件仍為草案。Exact provider contract/DPA、processing country/region、subprocessor、cross-border treatment、retention/deletion、incident term、no-training control、Taiwan market eligibility 與 counsel review 完成前，不得將相關 route 納入有效的 TW Production PolicyRelease。
